Sonatype Cloud Acceptable Use Policy

 

This Acceptable Use Policy (this “Policy”)applies to your use of all Services offered by Sonatype. The examples described in this Policy are not exhaustive. We may modify this Policy at any time by amending this page. By using a Service, you agree to the latest version of this Policy. If you violate the Policy or authorize or help others to do so, we may suspend or terminate your use of the Services. Defined terms shall have the meaning set forth in the applicable Services terms and conditions unless otherwise stated herein.

Prohibited Actions

You may not, and may not allow any third party, including its users, to use any Service for any illegal, harmful, fraudulent, infringing or offensive use, or to transmit, store, display, distribute or otherwise make available material that is illegal, harmful, fraudulent, infringing or offensive. This includes, without limitation, not using a Service to, nor allowing your Users or any third party to use a Service:

  • in any way that breaches any applicable law or regulation;
  • in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
  • to store or transmit material in violation of third-party privacy rights;
  • to send or store any malicious code, such as viruses, worms, time bombs, Trojan horses, and other harmful or malicious files, scripts, agents, or programs;
  • to send, upload, distribute, or disseminate, or offer to do the same, with respect to unlawful, defamatory, tortious, harassing, abusive, fraudulent, infringing, obscene, excessively profane, hateful, violent, or otherwise objectionable material, or promote, support, or facilitate unlawful, hateful, discriminatory, or violent causes;
  • to distribute, publish, send, or facilitate the sending of unsolicited mass e-mail or other messages, promotions, advertising, or solicitations (like “spam”);
  • to send, knowingly receive, upload, download, use or re-use any material which does not comply with the Company Data standards set out below; and/or
  • use a Service in any manner that would disparage Sonatype.

Save as permitted under an agreement with Sonatype or allowed by applicable law, you also agree not to:

  • interfere with or disrupt the integrity or performance of a Service and/or third-party data contained therein;
  • attempt to gain unauthorized access to a Service, or its related systems or networks;
  • except for use of the Data Feed (or any portion thereof) that is included in any Report generated by a Service, copy the Data Feed (or any portion thereof) for any use that is outside of any such Service;
  • except for use of the Data Feed (or any portion thereof) that is included in any Report generated by a Service, copy the Data Feed (or any portion thereof) for any use that is outside of any such Service;
  • create Internet links to a Service (other than creating a bookmark link to any such Service) or frame or mirror a Service on any other server or wireless or Internet-based device; and/or
  • use a Service for any purpose or in any manner involving information: (i) that identifies or can be used to identify a natural person; or (ii) otherwise may be deemed to be personal data or personal information under applicable laws or regulations including, (A) information relating to biometric or genetic data, health, racial or ethnic origin, political opinions, religious or philosophical beliefs, sex or sexual orientation, trade union membership, or personal payment or financial information, (B) consumer reports as defined in the Fair Credit Reporting Act (or similar legislation), as amended (“FCRA”), (C) non-public personal information as defined under the Gramm-Leach-Bliley Act (or similar legislation), as amended, (D) protected health information as defined under the Health Insurance Portability and Accountability Act (or similar legislation), as amended (“HIPAA”) that has not been de-identified in compliance with HIPAA, or (E) special categories of personal data as defined in the General Data Protection Regulation (or similar legislation), as amended (“GDPR”).

Company Data Standards

These standards apply to any and all Company Data (in whole and in part) which you provide to Sonatype or otherwise give Sonatype access to.

Company Data must:

  • be accurate; and
  • comply with all applicable laws (including all relevant laws and regulations in the USA and the country from which the Company Data is posted).

Company Data must not:

  • promote or assist any unlawful act or illegal activity;
  • contain any material which is defamatory of any person, obscene, offensive, hateful, abusive, inflammatory, invasive of privacy or otherwise objectionable;
  • promote sexually explicit material, violence or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
  • infringe or misappropriate the intellectual property or proprietary rights of others;
  • be used to impersonate another person, entity, or Sonatype (via the use of an email address or otherwise) or otherwise misrepresent themselves or the source of any communication;
  • be likely to deceive any person; and/or
  • be made in breach of any duty (legal or otherwise) owed to a third party, including without limitation a contractual duty or a duty of confidence.
